BUSINESS LAW & ETHICS

Reginald is selling is a vehicle. He has a classic 1978 Ford Bronco and wants to sell it so he can buy a new electric vehicle. He takes out an ad online and lists the vehicle for $55,000. Jane sees Reginald’s ad for the Bronco and contacts him to look at the car. She takes it to a mechanic that she trusts and the mechanic tells her that the car is in excellent shape for its age and she does not think it will need any immediate repairs.

Jane decides to purchase the Bronco and writes a $5500 check to Reginald as a ten percent deposit for the Bronco. The memo section of the check read: “Deposit on purchase of 1978 Ford Bronco owned by Reginald Doe. Sale price $55,000.” Reginald initialed the memo section next to this line and took the check out of the checkbook.

They agreed that she would return the next day with a cashier’s check for the rest of the money and he would give her the title and keys to the vehicle then.

When Jane returned the next day with $49,500 cashier’s check, Reginald said, “Sorry, I feel terrible about this but I sold the Bronco for $70,000 after you left yesterday to a local mechanic. She just called me out of nowhere after you left, made an offer, came by and paid me, and took the car last night.

I tore up your check so you won’t have to worry about canceling it.” Jane still has the duplicate copy of the check in her checkbook.

The cheapest comparable Bronco Jane can find elsewhere is $85,000.

Discuss in detail the following:

a.

What law applies in this situation (the common law or the UCC)? What is the difference? How is a contract formed anyway? Was a contract formed in this situation? (In answering this part of the question, please demonstrate how each element of contract formation is, or is not, established with these facts)

b.

What is the statute of frauds? Is the statute of frauds going to hurt Jane’s likely arguments under these facts? Why, or why not?

c.

Does Jane have any argument(s) to make in court against Reginald? For example, could she argue that Reginald breached a contract? What, if anything, could Reginald assert in his defense? Who do you think should prevail in the dispute and why?

d.

If she prevails, could Jane collect damages from Reginald? If so, what form and/or amount would they be?

Team Management Team

WEEK 6

Preparation

The following video is about many of Cournot’s contributions. Pay attention to the demonstration here of the Cournot Duopoly as a Nash equilibrium. The video nicely illustrates this complicated model with pictures—no math! This is exactly the game we play in this week’s discussion.

Your instructor may also post additional resources to help further explain concepts related to this week’s discussion.

Context

In our Managerial Economics textbook, we consider a sequential-move game in which an entrant is considering entering an industry in competition with an incumbent firm (see Figure 15-1). There are several possibilities of how this sequential game will be played. We want to use the Froeb rule of “look ahead and reason back.”

Post a Response

For your discussion post, use Figure 15-1 from the textbook as your starting point to address the following:

  1. Play and analyze the game. Can, and how does, the entrant succeed? Is the incumbent ever in control of this game? What is the Nash equilibrium?
    • You may wish to review the old game known as Duopoly, as well as Antoine-Augustin Cournot, to help inform your post.

A final

  1. You must provide motivation for the chosen topic and clearly express your objectives in the context of investment decisions in emerging markets.
  2. You must be able to collect, present, and analyze data relevant for the issues you consider. In other words, your essay should be an empirical work (literature survey are not permitted). The essay should also use market data (e.g., market returns, and other indicators).
  3. The permitted source of ALL market data is Refinitiv Eikon . Note: the number and the validity duration of allocated licenses is limited so plan your data collection phase well.
  4. At least two-thirds of the essay should be devoted to your results and their analysis. Do not waste very limited space on general introduction and detailed presentation of theory. Remember that you aim at demonstrating point 2 above.
  5. Your essay should provide evidence of extensive reading on the topic and ability to provide a focused and analytical discussion of the relevant issues.
  6. The essay should have a clearwell-organized structure. You should show an ability to relate evidence to theory. The essay must be clearly expressed and written with correct grammar and syntax.
  7. The essay must be carefully and accurately referenced.

This paper is resist, so extra caution is needed, the source of the data must be Refinitiv Eikon, it must be on the topic, it must be research on emerging markets. You need to be familiar with all the courseware, and you need to be familiar with all the professors’ emails and excellent papers from previous years as a reference. to meet all requirements.
