Purpose
The goals of this assignment are to provide a valuable skill and to assess your ability to comprehend and
apply case law. Reading, briefing, and applying what you are reading in your textbook and learning in the
modules are effective ways to become literate in the process of the U.S. legal system.
Conducting an Analysis
Before making and defending a decision, you must be familiar with the relevant law. For our purposes,
your textbook and course material provide all the legal concepts needed to apply the law to a factual
situation. Once you are familiar with the general content of the chapter, you should be able to recognize
the issue involved in a case and find the legal concepts that will help you decide the case. For your
reference, a sample analysis is provided at the end of this document.
First, you will read the assigned fact patterns (provided via a link in the module). Then, you will complete
an analysis for all fact patterns presented. Each analysis should contain the following:
1. The main issue. Identify and write (in your own words, at least 50% original) the central issue to be
decided. As much as possible, set the issue in legal terms and concepts.
2. Relevant legal concepts quoted from textbook court opinions. Search the assigned chapter for legal
concepts that will help you decide and justify your decision. Once you find the quotations you wish to use,
copy them into the appropriate places in your analysis.
3. Relevant case law quoted from the textbook.
4. Rationale. Write (in your own words, at least 50% original) a complete explanation about how you
used the legal concepts you cited to make a decision about how the case should be resolved.
5. Ruling. Describe (in your own words, at least 50% original) what should happen to the parties involved
as a result of your decision.

Since procedural due process rights cost the government time and money: “Courts generally therefore
generally try to balance accuracy against its cost on a case-by-case basis.”

Melinda Speelman v. Bellingham Housing Authority “Finally, … both the parties and the public have an
interest in ensuring that BHA administers its programs lawfully, Contrary to … contention, Speelman is
not asking for an exception to be applied to her case. She is asking that she be given the process due
her and everyone else in her situation. Therefore, the equities favor granting Speelman a preliminary
injunction.” (p.38)
Rationale (your own words):
Since BHA was aware that Speelman was in jail, they had an obligation to do more, even though they
reasonably attempted to reach Speelman. She was entitled to more due to the unusual set of
circumstances presented in the case and the failure to take additional action to properly serve Speelman
deprived her of her constitutionally guaranteed due process rights and she was put in a position of facing
eviction without benefit of a hearing.
Ruling (your own words)
The State of Kentucky need not provide hearings for denial of inmate visitors.
Sample Case Analysis in Essay Style
The main issue in this case is whether the State of Kentucky violated procedural due process by
depriving inmates of a protected liberty right to prison visitors, without a hearing to challenge a visitor who
is banned.
This is a due process case. Procedural Due Process is in the 14th Amendment – Section 1. “…nor shall
any state deprive any person of life, liberty, or property, without due process of law…” (pp. 28 & 671). The
relevant definitions here is the definition of liberty: “…a vast scope of personal rights. It also infers the
absence of arbitrary and unreasonable government restraints. (p. 29)
“The due process guarantee protects people from unfairness in the operation of both substantive and
procedural law.” Procedural law prescribes the method used to enforce legal rights. It provides the
machinery by which individuals can enforce their rights or obtain redress for the invasion of such rights.”
(p.29) Since procedural due process rights cost the government time and money: “Courts generally

The Court examined this issue in Connecticut Department of Public Safety v. John Doe, stating “In cases
such as Washington v. Constantineau (1971) and Goss v. Lopez (1975) we held that due process
required the government to afford the plaintiff a hearing to prove or disprove a particular set of facts.”
However, “…a convicted offender has already had a procedurally safeguarded opportunity to contest.”
“Plaintiffs who assert a right to a hearing under the Due Process Clause must show that the facts they
seek to establish in that hearing are relevant under the statutory scheme.” (p. 46)
Since the State of Kentucky had “…established regulations to guide prison officials in making visitation
decisions,” one could argue that an inmate’s liberty to have visitors has been recognized. It could be
further argued that denial of a hearing to challenge the finding that a specific visitor could be barred is
protected by due process. However, conducting court hearings requiring an adversary proceeding could
be unduly burdensome of the state and the liberty of an inmate has been deprived initially in a
procedurally safeguarded hearing. Deprivation of the liberty of convicted inmates to have specific visitors
is outweighed by the burden of conducting such hearings.
The court should rule in favor of the State of Kentucky.

Your Unit 4 Capstone paper is a culmination of everything you have researched about your selected topic in Criminal Justice. You will now synthesize your collected information. That means you will provide your personal assessment in a professional analysis in an 8–10-page Capstone research paper. Here is your roadmap:

  • Unit 1 – You wrote a problem statement and described the issue.
  • Unit 2 – You created a video that provides an overview of the issue.
  • Unit 3 – You conducted research by creating 8 Annotated Bibliographies.
  • Unit 4 – You will now use your Unit 3 Annotated Bibliography to create your Literature Review, which is one component of your Capstone paper. You will include a title page, an introduction to the problem, a topic analysis, a conclusion and a reference page See below for more information on how to write your Literature Review – and how to format your Capstone paper.

Here is a basic outline for you to follow for your Unit 4 Capstone paper:

  • Title Page – APA formatted.
  • Introduction to the Problem – (1 to 2 pages) – This is where you analyze the issues or problems in your chosen Capstone topic. You may reuse your IP1 paper for this part of your Capstone paper, as long as you make any applicable updates, based upon your research and edit it so that it is not longer than 2 pages.
  • Literature Review – (4 to 6 pages) – This is where you discuss or write about background information that you discovered when you completed your 8 Annotated Bibliographies in Unit 3. Do not copy-and-paste your Annotated Bibliography into your Capstone research paper. Instead, write in paragraph form, about the information that you discovered and documented in your Annotated Bibliography. Specifically, in your literature review, you will analyze what those authors wrote about in their articles. You should be able to write a minimum of at least ½ page (or more) for each of the 8 annotated bibliographies that you submitted in your Unit 3 assignment.   • Topic Analysis – (2 to 3 pages) – This is where you present your own personal, professional and scholarly analysis about your Capstone issue(s), which is based on all of your research.
  • Conclusion – (1 or 2 paragraphs, with 3 to 6 sentences per paragraph) – This is where you present your final conclusions and recommendations on how to mitigate or possibly solve the Capstone problem(s) that were identified. Your conclusions and recommendations should represent a synthesis of all that you have learned over the course of the program. You should be taking what you have learned and building upon that learning; combining concepts, skills and competencies into your final recommendations, demonstrating a deeper understanding of the issues based on your research and accumulated of learning.

You have recently applied for another position in the company you work for and have been called in for a second interview! For this round, you’ve been asked by the interview committee to present an analysis of the collected data from the research you initially reviewed, with a specific focus on data-collection types. This will be presented in a formal interview presentation.

You are analyzing studies related to a research topic in your field by discussing different types of data collection, their benefits and drawbacks, and how your chosen research studies utilize different collection methods. In your first project, completed in Module Four, you completed your initial analysis of the methodologies used. In your second milestone, also submitted in Module Four, you finalized your research choices by submitting two of each type of research methodology and flexing your “skilled consumer of research” skills by looking at your gathered research as a whole in order to identify patterns in data-collection types and some high-level credibility threats to the research. For this project, complete the following:

  1. Describe the attributes of a skilled consumer of research. Include the following:
    1. The most helpful perspectives a consumer can utilize
    2. A description of how you know when you have enough information
    3. A description of how you scrutinize the credibility of data
  2. Identify multiple potential threats to the credibility of your research results for each of your selected research studies. Include the following:

As a formerly incarcerated individual, I firmly believe that sentencing reforms are needed to reduce the number of women in prison. The current state of the criminal justice system disproportionately affects women, particularly those involved in drug-related offenses, leading to devastating consequences for families and communities.

The increase in the number of women in prison can be attributed to several factors, including sentencing structures that fail to consider women’s unique circumstances and needs. Harsh mandatory minimum sentences and punitive drug policies have resulted in the incarceration of many women who are unwittingly or peripherally involved in drug activity, often due to their relationships with partners or family members who use or sell drugs.

Moreover, the lack of living wage jobs and the reduction of public assistance have left many women with limited options to support their families, driving some to turn to the drug trade to survive. These socio-economic factors intertwine with drug policies, further contributing to the over-incarceration of women.

One key phrase that comes to mind when discussing the impact of drug policies on women is “equality with a vengeance.” This phrase reflects how the war on drugs has been executed without considering the gender-specific circumstances women face. While striving for equality in law enforcement, the justice system has inadvertently perpetuated inequality by disproportionately incarcerating women who often act out of necessity and desperation to support their families.

To address this issue, sentencing reforms must be implemented to reduce the number of women in prison. The criminal justice system should focus on diversion programs, treatment options, and rehabilitation rather than resorting to punitive measures for nonviolent drug offenses. Such reforms would allow women to break free from the cycle of incarceration and re-enter society as productive members.

Furthermore, community-based programs that provide job training, education, and social services are vital in empowering women to make positive choices and avoid criminal activities. We can create a more equitable and just society by addressing the root causes of women’s involvement in the drug trade.

The current sentencing structures and drug policies have disproportionately impacted women, resulting in a surge in the number of incarcerated females. To rectify this issue, sentencing reforms are essential to ensure fair treatment and address the specific needs of women. Emphasizing rehabilitation and support over punitive measures will reduce the number of women in prison and contribute to stronger families and communities.
